1 وصف الخدمة والقبولService Description & Acceptance

JawabStar ('Service') is an AI-powered SaaS platform for managing Google Business Profile review responses. The Service provides automated monitoring, smart response drafting, and approval workflows. By accessing or using the Service, you fully agree to be bound by these Terms including our Privacy Policy. If you disagree, cease using the Service immediately.

2 إخلاء مسؤولية الذكاء الاصطناعي الشاملComprehensive AI Disclaimer

تحذير حاسم: جميع المحتوى المولد بالذكاء الاصطناعي ('مخرجات AI') مقدم 'كما هو' لأغراض إعلامية فقط. ليس بديلاً عن الحكم البشري أو الاستشارة المهنية. قد تحتوي المخرجات على أخطاء أو عدم دقة أو محتوى غير مناسب. أنت مسؤول بالكامل عن: (أ) مراجعة شاملة لكل مخرجات AI قبل الاستخدام أو النشر، (ب) التحقق من الدقة والملاءمة، (ج) أي قرارات أو إجراءات مبنية على هذه المخرجات. جواب ستار لا تتحمل مسؤولية أي أخطاء أو عواقب من استخدام مخرجات AI، بما في ذلك الأضرار للسمعة أو الخسائر المالية أو المسؤولية القانونية.">CRITICAL WARNING: All AI-generated content ('AI Output') is provided 'as-is' for informational purposes only. Not a substitute for human judgment or professional advice. Output may contain errors, inaccuracies, or inappropriate content. You are solely responsible for: (a) comprehensive review of all AI Output before use or publication, (b) verification of accuracy and appropriateness, (c) any decisions or actions based on this Output. JawabStar assumes no responsibility for any errors or consequences from using AI Output, including reputational harm, financial loss, or legal liability.

3 حد المسؤوليةLimitation of Liability

Total Liability Cap: JawabStar's maximum total liability shall not exceed the total amount paid by User to the Service in the twelve (12) months immediately preceding the claim, with a minimum of zero. This cap applies to all claims of any kind.

Excluded Damages: Completely excluded from liability are: (a) consequential or indirect damages, (b) special or incidental damages, (c) punitive or exemplary damages, (d) lost profits or anticipated revenue, (e) loss of data or file contents, (f) business interruption or lost business opportunities, (g) reputational harm, (h) any non-tangible damages. These exclusions apply even if JawabStar was advised of the possibility of such damages.

4 التعويض من قبل المستخدمUser Indemnification

User agrees to indemnify, defend, and hold harmless JawabStar and its officers, directors, and advisors from and against all claims, lawsuits, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) User's use or misuse of the Service, (b) User's violation of any provision of these Terms, (c) User's violation of any applicable law or regulation, (d) User's infringement of third-party rights (including intellectual property or privacy), (e) User Content or data uploaded or published via the Service, (f) User's actions or conduct in using the Service.

5 عدم الضمان الشاملComplete Disclaimer of Warranties

The Service is provided 'as-is' and 'as-available'. JawabStar explicitly disclaims all warranties, express or implied, including: (a) merchantability, (b) fitness for a particular purpose, (c) non-infringement, (d) accuracy or completeness, (e) performance or quality. JawabStar does not warrant: that the Service will be uninterrupted or error-free, that generated content will be accurate or appropriate, that errors will be corrected, that results will meet your expectations or needs.

6 الاستخدام المقبول والحظرAcceptable Use & Prohibited Activities

You agree to use the Service only for lawful purposes and in compliance with all applicable laws. Strictly prohibited:

7 ملكية البيانات والترخيصData Ownership & License

User retains all ownership rights in User Data (data you upload). JawabStar receives a limited, non-exclusive license to process User Data solely for Service delivery. JawabStar may not use User Data for any other purpose without explicit written consent. Upon account deletion, all User Data will be permanently deleted within 30 days, though we reserve the right to maintain backups for backup recovery purposes for up to 90 days.

8 القوة القاهرةForce Majeure

JawabStar shall not be liable for any failure or delay in performance caused by events beyond reasonable control ('Force Majeure Events'), including but not limited to: natural disasters, wars, pandemics, strikes, government actions, internet disruptions, or data center failures. Such events do not constitute breach and excuse JawabStar's obligations.

9 الإنهاء والتعليقTermination & Suspension

Termination by User: You may terminate your account at any time via Settings. Termination is effective immediately.

Termination by JawabStar: JawabStar may suspend or terminate your account immediately and without prior notice if: (a) you breach any provision of these Terms, (b) you violate any law or engage in illegal activity, (c) you fail to pay fees due within 7 days of notice, (d) the Service is endangered or abused, (e) JawabStar determines in its sole discretion that continued Service poses legal risk. No refund upon termination for cause.

10 التعديلات والإشعاراتModifications & Notices

Right to Modify: JawabStar reserves the right to modify the Service or any portion at any time, including features, pricing, or content. Material modifications require 30-day email notice before effect. Continued use after notice constitutes acceptance.

11 التحكيم الإلزامي وحل النزاعاتBinding Arbitration & Dispute Resolution

القانون الحاكم: تخضع هذه الشروط وأي نزاع للقانون السعودي دون اعتبار لأحكام تضارب القوانين.

التحكيم الإلزامي: أنت توافق على أن أي نزاع أو مطالبة يتم حلها حصراً من خلال التحكيم الملزم وفقاً لقواعس غرفة التجارة السعودية. التحكيم يكون نهائياً وملزماً وغير قابل للاستئناف. يُستثنى من التحكيم: طلبات الإغاثة المؤقتة أو المنع من المحاكم.">Governing Law: These Terms and any dispute are governed by Saudi law without regard to conflict of law principles. Binding Arbitration: You agree any dispute shall be resolved exclusively through binding arbitration under Saudi Chamber of Commerce rules. Arbitration is final, binding, and not subject to appeal. Excluded from arbitration: requests for emergency or injunctive relief from courts.

12 صيانة الخدمة وتوفرهاService Maintenance & Availability

JawabStar targets 99% Service availability. 100% uptime is not guaranteed. Planned maintenance may occur without advance notice. Emergency downtime may result from events beyond control. No liability for access loss or data loss resulting from outages.

13 الالتزام الكامل والانفصاليةEntire Agreement & Severability

These Terms with our Privacy Policy constitute the entire agreement between you and JawabStar. If any court finds any provision unenforceable, that provision will be modified to the minimum necessary extent and all other provisions remain in full effect.

14 الامتثال لواجهة برمجة جوجلGoogle API Compliance

Must display Google attribution. Cannot store review data longer than 30 days without re-sync. Cannot modify review content.

15 عدم التنازل والإشعاراتWaiver & Notices

عدم فرضنا لأي حق أو حكم لا يشكل تنازلاً عن هذا الحق أو أي حق آخر. جميع الإشعارات المطلوبة يجب أن تكون كتابية وتُرسل إلى البريد الإلكتروني المسجل.">Our failure to enforce any right or provision does not constitute a waiver of that right or any other right. All required notices must be written and sent to your registered email.
